1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and CreativeHubPH ("CreativeHubPH," "we," "us," or "our") governing your access to and use of the CreativeHubPH website, API services, and associated mobile/web tools (collectively, the "Platform").
By registering an account, clicking "Sign up," checking the consent box, depositing funds into the wallet, paying an invoice, or utilizing the platform services, you acknowledge that you have read, understood, and agree to be bound by these Terms, the Privacy Policy, the Cookie Policy, and the Acceptable Use Policy. If you do not agree, you must immediately cease using the Platform.
2. Accounts, Verification & Security
To access key marketplace functionalities, you must create a profile designated either as a Client (seeking to hire) or a Freelancer (seeking to offer services).
- Eligibility: You must be at least 18 years old and capable of forming legally binding contracts under Philippines law.
- Account Integrity: You are responsible for keeping your login credentials confidential. We encourage configuring optional Two-Factor Authentication (2FA) via SMS/Authenticator inside settings to prevent unauthorized access.
- Account Verification: To maintain trust, secure financial transactions, and prevent fraudulent activity, users are encouraged to verify their identity through our manual verification system. Users can submit government-issued identification documents and selfies for review by CreativeHubPH Administrators and Moderators. Approval awards a verified trust badge check mark on the Platform. Failure to complete identity verification, or submitting fraudulent documentation, will lead to account restrictions, including limits on wallet transfers, invoice generation, and balance withdrawals.
- Suspension: We reserve the right to suspend or terminate accounts that provide fraudulent information, engage in system abuse, bypass platform payment flows, or violate moderation policies.
3. Platform Rules & Communication
CreativeHubPH provides messaging systems, file sharing, and workspace collaboration portals to coordinate projects.
User-Generated Content and Communications Standards:
- Users are solely responsible for the files, code, messages, and portfolios they post. You guarantee that your uploads do not infringe third-party copyright, patent, or intellectual property rights.
- All communication concerning active projects, specifications, agreements, and invoice confirmations should occur inside the platform's chat systems to establish a record for dispute moderation.
- Spamming, harassment, sharing malware, or attempting to lure users off-platform for payment processing is strictly prohibited and constitutes grounds for immediate account banning.
4. Fees, Payments & Escrow
All financial transactions are conducted in Philippine Pesos (PHP) and processed securely through **our integrated payment gateway partners**.
- Wallet System: Clients can add funds to their wallet balance via supported payment gateway deposits. Freelancers accumulate earned balances from approved invoices. Available balances can be withdrawn to linked bank accounts or e-wallets.
- Project Invoicing & Escrow: For project-based and hourly work, freelancers issue invoices. When a client pays an invoice or funds a project milestones, the funds may be held in escrow by the platform until project targets are approved.
- Subscriptions: Monthly retainer subscriptions between clients and freelancers are charged automatically via recurring subscription billing according to agreed intervals.
- Platform Fees: CreativeHubPH charges freelancers a platform service fee percentage on completed invoices, which is automatically deducted prior to wallet balance release. Payment processing fees from our payment partners are detailed in the Payments & Refund Policy.
5. Moderation & Dispute System
We provide structured dispute channels to handle project-based and invoice billing disagreements:
Project & Invoice Dispute Process
If a client is unsatisfied with freelancer deliveries or if a freelancer claims non-payment for completed milestones, either party may file a formal dispute request.
Upon receipt of a dispute, CreativeHubPH Admin Moderation will lock the escrowed funds and review the contract details, time logs, chat transcripts, and files shared inside the platform. The Admin Moderation decision is final and binding on both parties regarding the allocation of escrowed balances.
Crucial Note: Initiating chargebacks or payment disputes outside the platform bypasses the admin arbitration system and is a direct violation of these Terms. It may result in the immediate and permanent suspension of your account and forfeiture of wallet balances.

No Overseas Employment Services
CreativeHubPH does not provide overseas employment, recruitment, manpower placement, job placement abroad, or work-abroad services. The platform is for project-based creative and digital services only.
6. Intellectual Property Rights
Unless otherwise mutually agreed upon in a custom contract signed by both Client and Freelancer:
- Freelancer Ownership: Freelancers own all intellectual property rights, copyrights, and source codes for work products generated during a project until payment has been cleared.
- Transfer on Payment: Upon full payment of the invoice by the Client and release of the corresponding funds to the Freelancer's wallet, the ownership and copyright of the work product transfer automatically and in full to the Client.
- Platform License: Users grant CreativeHubPH a limited, worldwide, royalty-free, non-exclusive license to host, display, and share portfolio uploads, reviews, and descriptions solely to operate and promote the platform.
7. Limitation of Liability
CreativeHubPH functions solely as a matchmaking and payment facilitation marketplace. We are not an employer, partner, or joint venturer of any freelancer.
IN NO EVENT SHALL CREATIVEHUBPH, ITS OFFICERS, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH PROJECTS, DELIVERABLES, DISPUTES, OR THE USE OF THE PLATFORM, EXCEEDING THE TOTAL FEES PAID BY YOU TO CREATIVEHUBPH IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
8. Governing Law & Dispute Resolution
These Terms and all aspects of the relationship between you and CreativeHubPH shall be governed by, and construed in accordance with, the laws of the **Republic of the Philippines**, without regard to conflict of law principles.
Any legal action, dispute, or controversy arising out of these Terms that cannot be settled amicably through platform moderation shall be referred to and resolved by binding arbitration in **Metro Manila, Philippines**, in accordance with the Alternative Dispute Resolution Act of 2004 (R.A. 9285) and the rules of the Philippine Dispute Resolution Center, Inc. (PDRCI).
