Freelancer Agreement

1. Independent Contractor Status
This Freelancer Agreement ("Agreement") governs the terms under which you participate as a Freelancer on **CreativeHubPH**.
You explicitly acknowledge and agree that your relationship with CreativeHubPH is strictly that of an independent contractor. Nothing in this Agreement shall be construed to create an employer-employee relationship, partnership, agency, or joint venture between you and CreativeHubPH, or between you and any Client.
You are solely responsible for determining your hours, location, rates, and methods of work. You are responsible for all taxes, social security contributions, insurance, and licensing requirements associated with your earnings, in compliance with the laws of the Republic of the Philippines (including Bureau of Internal Revenue / BIR regulations).
2. Profiles, Portfolios & Reviews
To display your services, you must create a freelancer profile.
- Accuracy: All descriptions, skills, portfolios, and rates published on your profile must be accurate and truthful. You may not misrepresent your experience, credentials, or country of origin.
- Portfolio Assets: By uploading portfolio images, videos, links, or documents, you guarantee that you own the rights to these assets or have obtained explicit permission to showcase them. Infringing materials will be removed immediately.
- Ratings & Reviews: Clients may evaluate your performance and leave public ratings and comments on your profile. You agree not to manipulate or purchase ratings, nor coerce clients into providing positive feedback. Reviews represent client opinions and CreativeHubPH is not liable for their content.
3. Time-Tracking & Hourly Logging
For hourly contracts, you must track your work using the Platform's time-tracking tool.
Hourly Tracking Rules & Guidelines:
- You must log active work sessions directly associated with the designated project. Time tracking must be backed by accurate descriptions of the tasks performed.
- Hourly logs and work records are accessible by the Client. If a Client disputes logged hours, CreativeHubPH will investigate. We reserve the right to reject logs that represent idle time, personal browsing, or duplicate tracking.
- Hours logged outside the official time-tracking tool are not protected by our payment protection policies and cannot be processed as guaranteed hourly payouts.
4. Platform Fees & Invoicing
You must issue all invoices and accept payments exclusively through the CreativeHubPH billing and invoice system.
- Service Fees: CreativeHubPH charges a platform service fee on all earnings cleared through our system. The standard service fee is automatically deducted from the invoice amount before funds are credited to your platform wallet.
- Invoicing: You agree to create accurate billing entries detailing your rates, hours (if hourly), and milestones (if project-based). Bypassing invoices to receive direct payments off-platform constitutes a material breach of this Agreement.
- Escrow Holds: For project milestones, payments made by clients are held in escrow. Once a client approves the milestone or the admin resolves a dispute in your favor, the funds (less platform fees) are released to your wallet.
5. Intellectual Property Transfer
Ownership of your work deliverables remains your property until the corresponding invoice is paid in full:
IP Release Conditions
You retain all copyrights, design rights, patents, trade secrets, and ownership rights for files, code, graphics, or assets generated during a contract until the Client settles the invoice and funds are released into your platform wallet.
Immediately upon release of the invoice payment to your wallet balance, all copyrights and ownership of the deliverables transfer automatically and irrevocably to the Client, granting them full, unrestricted rights to use, modify, and publish the work.
6. Wallet Balances & Bank/E-Wallet Payouts
Your earnings are credited to your available platform wallet balance.
- Withdrawal Requests: You may request to withdraw your available balance. Withdrawals are processed to your configured bank account or e-wallet payout destination.
- Processing Timelines: Standard withdrawal requests are processed within one (1) to three (3) business days, subject to security reviews and fraud checks.
- Withdrawal Constraints: You cannot withdraw pending balances (funds still in escrow or subject to an active dispute). Additionally, your account must have a verified phone number and completed government ID check to authorize withdrawals.
- Payout Fees: Any fees charged by payment providers or financial institutions for receiving payouts or transferring funds are your sole responsibility and are separate from CreativeHubPH platform fees.
7. Verification & Anti-Fraud Compliance
To protect clients and ensure marketplace safety, you agree to:
- Government ID Verification: Uploading clear images of valid government IDs to verify your legal name and identity. This data is handled in compliance with our Privacy Policy and the Data Privacy Act of 2012.
- Security Audits: Submit to audits if our fraud detection systems flag suspicious hourly logging patterns, suspicious withdrawal requests, or login changes.
- Account Penalties: Failure to comply with verification requests, bypass attempts, or submitting falsified records will lead to account suspension, withholding of disputed escrow balances, and deletion of your profile.
